Throughout these Terms and the application, you'll see references to "Companies" and "Teams". These terms can be confusing, so let's clarify:
A "Company" in Elevator Planner is a collaboration group that YOU and your colleagues create to share work information with each other. It is NOT:

If you work for "Some Elevator Corporation", you and your colleagues can create a "SOMEELEVATOR" group as "Company" in the app to share route information and maintenance records with each other. But "Some Elevator Corporation" (the actual company) has NO access to this group, doesn't control it, doesn't track you by it, doesn't pay for it, and doesn't even know it exists unless you tell them.
A "Team" is a collaboration group similar to "Company", but with key differences:

Elevator Planner was created by a working elevator mechanic who understands the challenges of managing complex routes, tracking equipment across multiple buildings, and coordinating with colleagues. This tool exists to make YOUR work life easier - not to make it easier for companies to monitor or manage you.
Now, let's get to the formal Terms of Service:
By accessing or using Elevator Planner ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Elevator Planner is a web-based application designed to help elevator mechanics manage routes, track equipment, and optimize daily workflows. The Service is intended for professional use by licensed and unlicensed elevator mechanics.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
Important: Each mechanic pays individually ($4/month soft launch, $15/month regular). There are NO corporate or group subscriptions.
Employer Reimbursement: Your employer may choose to reimburse you for the subscription cost as a business expense. However, this is entirely between you and your employer. Elevator Planner does NOT offer corporate accounts, corporate billing, or direct employer payment arrangements.
To access collaboration features (Companies), you must verify your NY State elevator mechanic license.
We verify licenses using publicly available NY State Department of Labor records that anyone can access.
What we verify:
We do NOT access any non-public information or share your data with regulatory bodies.
New users receive a 90-day free trial with full access to all features. No credit card or payment information is required to start your trial.
Payment card is required once - when and only when you decide to subscribe.
No surprises. No automatic charges. No "gotchas."
Payments are processed securely through Stripe™. We do not store your payment card information. By subscribing, you authorize recurring monthly charges to your payment method.
Fair Billing Promise:
If you subscribe before your trial ends, we will NOT charge you until your trial period is complete. Your first payment will occur on the day your trial would have expired, ensuring you get the full 90 days free.
Example:
After your first payment, subscriptions renew automatically on a monthly basis. You will be charged on the same day each month *.
* For months that don't have your billing date (e.g., February doesn't have a 31st), you'll be charged on the last day of that month.
You agree to use the Service only for lawful purposes and in accordance with these Terms. Please review our Acceptable Use Policy for detailed guidelines.

Just as a paper maintenance log in a machine room stays with the building when a mechanic leaves the company, Work Records you contribute remain with your Company/Team group to ensure continuity of service.

IMPORTANT: You Are Responsible For What You Share
When sharing information as Work Records, you must ensure you have the legal right to share that information.

Indemnification:
You agree to indemnify and hold harmless Elevator Planner from any claims arising from:
In plain English: If you share something you shouldn't have shared, and your employer sues - that's between you and your employer, not Elevator Planner.
The Service, including all software, design, text, graphics, and other content, is owned by Elevator Planner and is protected by copyright and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal professional use in accordance with these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Consumer Rights: This disclaimer does not affect statutory rights that cannot be waived under applicable consumer protection laws. If you are a consumer in the European Union or certain US states, you may have additional rights that this disclaimer does not affect.
Professional Responsibility: You are solely responsible for the proper inspection and maintenance of elevators. The Service is a planning tool and does not replace professional judgment or regulatory compliance requirements.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATOR PLANNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You may cancel your subscription at any time through your account settings or by contacting us at info@elevatorplanner.com. Cancellation will take effect at the end of your current billing period.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.
Upon termination, your right to access and use the Service will immediately cease. You may request a copy of your data within 30 days of termination.
We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in New York County, New York.
Exception for EU Users: If you are a consumer in the European Union, this arbitration clause does not apply to you. You retain the right to bring disputes in your local courts as provided by EU consumer protection law.
